Blowhole Incident: State not at fault

When David Potts entered the blowhole park he was made very aware that the area was dangerous and that he was entering at his own risk. Even after David Potts disappeared tourist where still seen gathering near the blow hole despite hearing about his disappearance despite what had happened; showing the carelessness of certain tourist and how the state or land owners should not have to take the responsibility of the tourist actions.

In the front of the park that leads to the blowhole there is in fact one hand painted sign that states, " Blow Hole Park: enter at own risk".  That sign states in the simpliest form that as soon as you enter the park no one except yourself is liable for you. For most of the cases involving visitors most of the times it is the tourists fault.  For example in the case involving Daniel Dick of Sylmar, Californis there was a sign in the parking lot which he chose to ignore and still walked to the water spout and was later lifted three to five feet in the air and fell hitting his head and died.  In that case it was also his own fault because he decided to go there despite the sign and knowing there was a dangerous water spout.

Sufficient evidence shows that most of the times with a few exceptions like the rockslide in sacred falls that visitors in hawaii are given sufficient warning but decide to ignore the warnings and common sense and get hurt.  In the blowhole incident I believe that no one except the missing man is at fault.
